GENERAL PROVISIONS

These terms and conditions are valid exclusively between the company Princes Srl Via M.Biagi – 63812 – Montegranaro (FM) – Italy – P.Iva/Cod.Fisc. 00728420449,– VAT Reg. ID / Tax Code: 00728420449 hereafter “PRINCES” and any person making online purchases on the website www.joghost.com hereafter ”CUSTOMER”. These conditions may be subject to change and they shall be effective as of the date of their publication on the website.

These conditions govern purchases made on the www.joghost.com, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, LD No. 206/2005, as amended by DL No. 21/2014 and LD No. 70/2003 on e-commerce.

ARTICLE 1 – OBJECT OF THE CONTRACT

Through these terms and conditions of sale, PRINCES sells and the CUSTOMER remotely purchases the tangible movable goods indicated and offered for sale on the website www.joghost.com. The contract is entered into exclusively through the internet, by the CUSTOMER accessing the address www.joghost.com where purchase orders are made in accordance with the procedure set forth on the site itself. The order form shall be stored in Princes’s database for as long as necessary for the fulfilment thereof and in accordance with the law. The user may access the order form and its details through their individual user account.

The customer undertakes to peruse, before confirming their order, these terms and conditions of sale provided by PRINCES and to accept them by checking the box indicated.

In the order confirmation email, the CUSTOMER will also receive a link for downloading and storing a copy of these terms and conditions of sale, as provided for by Art. 51 (1) of LD 206/2005, as amended by LD 21/2014.

The CUSTOMER may, at any time, and in any case before entering into the contract, peruse information related to PRINCES, its geographical address, telephone and fax number, email address, information that is reported, including below:

ARTICLE 2 – AGREEMENT AND EFFECTIVENESS OF THE CONTRACT

The sales contract is considered agreed when PRINCES sends the CUSTOMER an email confirming the order. The email contains the CUSTOMER’s details and the order number, the price of the purchased goods, the shipping costs and the delivery address to which the goods will be shipped and a link for printing and storage of a copy of these conditions.

The CUSTOMER undertakes to check that their personal details are correct and to notify PRINCES promptly of any corrections required.

PRINCES undertakes to describe and present the items sold on the website as accurately as possible. Nevertheless, there may be minor errors, inaccuracies or differences between the site and the real product. Moreover, the photographs of the products posted on www.joghost.com. are non contractual elements, they are merely illustrative.

PRINCES undertakes to deliver the goods within 30 days of the date of the order confirmation email sent by PRINCES to the CUSTOMER.

The presentation of products is an invitation to offer.

The order submitted to the merchant will be deemed a purchase contract proposal addressed to Romagnoli for each product considered individually. Orders are processed immediately following confirmation of product availability and payment. In the event of errors, the amount charged to your credit card can be reimbursed.

ARTICLE 3 – AVAILABILITY OF PRODUCTS

The availability of the products means their actual availability when the CUSTOMER places the order. This availability must, however, be considered purely indicative because, multiple users may be using the site at the same time and the products may be sold to other CUSTOMERS before order confirmation.

Even once the order confirmation email is sent by PRINCES, there may be cases of partial or total unavailability of the goods. In such cases, the order will be corrected automatically by removal of the unavailable product and the CUSTOMER will be informed immediately by email.

If the CUSTOMER requests the cancellation of the order, thus terminating the contract, PRINCES will refund the amount paid within 14 days of the day on which PRINCES was made aware of the customer’s decision to terminate.

ARTICLE 4 – PAYMENT METHODS

Bank transfer

The reference number of the transfer issued at the time of purchase, the name and surname of the customer must be indicated in the reason for the transfer.

Once the credit has been received, we will proceed with the shipment.

ARTICLE 5 – PRICES

The Product prices on the Website are in € (Euro) duties are not included. Shipment costs are excluded, save as otherwise indicated.

ARTICLE 6 – RIGHT OF WITHDRAWAL / EXCHANGE

RIGHT OF WITHDRAWAL

If the customer, for any reason, is not satisfied with the purchase, s/he has the right to withdraw from the contract, without any penalty within 14 (fourteen) working days (Monday to Friday) of receipt of the goods.

Withdrawal must be expressed by sending, by the above deadline, written communication with return receipt to the following address:

This communication must contain an expression of the desire to exercise the right of withdrawal pursuant to Article 52 of the Consumer Code, the indication of the Products for which the Customer wants to exercise the right to withdraw and the purchase order number.

Within the same period an email (info@princescalzature.com) may be sent, which must be followed within 48 hours by the above-mentioned written communication, with acknowledgement of receipt to confirm the expressed withdrawal.

 

Within the above-mentioned 14 (fourteen) day period, all purchased goods must be returned to the shipper-supplier, without any sign of wear and tear, in their original packaging and with any accessories, with no omissions.

PRINCES will be responsible for the return fees.

Once the goods have been received, PRINCES will forward the full amount paid by the Customer within 14 (fourteen) days of notice of withdrawal or receipt of the goods. The credit funds will in any case be available on the same date as the debit.

 

EXCHANGE OF GOODS

If the customer, for any valid reason, is not satisfied with the purchase, s/he has the right to ask for the product to be exchanged, without any penalty, within 14 (fourteen) working days (Monday to Friday) of receipt of the goods.

The goods exchange request must be expressed by sending, by the above deadline, written communication with return receipt to the following address:

Princes Srl Via M.Biagi, 63812 – Montegranaro (FM) – Italy; within the same period an email (info@princescalzature.com) may be sent, to be followed within 48 hours by the above-mentioned written communication, with acknowledgement of receipt, confirming the desire to exchange the purchased product.

 

These communications must contain an expression of the desire to exchange the goods, indicating the Products for which the Customer wishes to exercise the right of exchange; the purchase order number; the reason for the exchange request, the Product with which the return is to be replaced, taking care to specify the code, size and colour of the new Product.

Within the above-mentioned 14 (fourteen) day period, all purchased goods must be returned to the shipper-supplier, without any sign of wear and tear, in their original packaging and with any accessories, with no omissions.

The goods to be replaced must reach the supplier-vendor within 30 (thirty) days of their delivery to the Customer.

The replacement goods will be sent only once the Products to be exchanged by the Customer have been received and examined by PRINCES.

PRINCES is prepared to exchange the Customer’s goods once only.

If the requested replacement goods are unavailable, PRINCES will allow the CUSTOMER to choose another Product of equal value, within four months of the date of the first purchase order, after which the Customer will lose the right to exchange the goods and the price paid will not will be refunded.

 

IMPORTANT: refunds of purchased items will not be accepted if the above procedures are not followed.

ARTICLE 7 – LEGAL GUARANTEE OF CONFORMITY

If the products received do not comply with orders or are defective, the CUSTOMER has the right to restoration, at no expense, of product conformity by repair or replacement of the product. The CUSTOMER may exercise this right if the defect occurs within two years of delivery of the goods and the defect is reported to PRINCES within two months of discovery. This guarantee does not include defects and products defined as non-compliant as a result of wear and tear of the product itself.

ARTICLE 8 – DELIVERY METHODS AND TAXES

Orders are processed immediately following confirmation of product availability and payment. In the event of errors, the amount charged to your credit card can be reimbursed.

PRINCES – ships via DHL Average delivery times for Italy and EC countries are 2/3 days, Monday to Friday, excluding national and international public holidays.

PRINCES assumes responsibility for loss / damage to goods from shipment to delivery to the CUSTOMER.

Shipping costs vary depending on destination and package weight. Before final check-out during purchase, the system will calculate the shipping costs and add them to the total price.

Taxes and duties: PRINCES ships DDP (Delivery Duty Paid) in EC countries, so for these destinations goods will arrive directly at the place indicated without the need to pay anything other than the payment during order placement. For all other countries, DDU (Delivery Duty Unpaid) shipping is used, so the courier may present a separate invoice to request payment of the duties and taxes imposed by the local authorities. Customers in non-EU countries are advised to inquire about local taxes and duties before placing an order on www.joghost.com

ARTICLE 9 – LIABILITY

PRINCES shall in no way be liable for disruptions caused by force majeure or unforeseeable events, including Internet malfunctions and disruptions, if it fails to fulfil the order within the contractual time.

 

ARTICLE 10 – ACCESS TO THE WEBSITE

The CUSTOMER has the right to access the website for browsing and purchasing purposes. No other use, in particular commercial, of the site or its contents is permitted. All of the elements on the site, whether audio or visual, and the technology used remain the property of PRINCES and are protected by copyright.

ARTICLE 11 – COOKIES

The website www.joghost.com uses cookies. Cookies are electronic files recording information on the CUSTOMER’s navigation on the site (pages viewed, date and time of browsing, etc.) to allow PRINCES to offer a customized service to its customers.

ARTICLE 12 – ENTIRE AGREEMENT

These Terms and Conditions of sale include the entirety of their constituent clauses. If one or more provisions of these Terms and Conditions of Sale is deemed invalid or declared as such by the law, by regulations or following the decision of a court with jurisdiction, the other provisions will remain in full force and effect.

ARTICLE 13 – APPLICABLE LAW AND JURISDICTION

Jurisdiction: “For civil disputes related to the application of Sections I to IV of this Chapter the mandatory territorial jurisdiction lies with the judge of the place of residence or domicile of the consumer, if it is within the State.”

ODR: “Pursuant to Art. 14 of Regulation 524/2013, the user is informed that in the event of a dispute, he / she can lodge a complaint via the European Union ODR platform which can be accessed through the following link http://ec.europa.eu/consumers/odr/. ADR: “According to article 49 (1) (V) of DL of 6 September 2005 No. 206 (Consumer Code) the customer can use the Joint Conciliation procedure.

The Procedure may be initiated if the consumer has not received a reply or has received a response that s/he does not consider to be satisfactory within 45 days of lodging a complaint with the company.
